1. Acceptance of Terms

By accessing our website, booking a lesson, or undertaking driving instruction with RevUp Driving School (“we”, “us”, “our”), you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms, you must not use our services.

If the student is under 18 years of age, a parent or legal guardian must provide consent.

2. Lesson Bookings

  • All lessons must be booked in advance via phone, messaging platform, or online (where available).
  • Lesson time includes pick-up and drop-off unless otherwise agreed.
  • All bookings are subject to availability.
  • We reserve the right to refuse or cancel bookings where necessary, including where these Terms are breached.

3. Payments

  • Payment is required before or at the commencement of the lesson unless otherwise agreed.
  • Prices are listed in Australian Dollars (AUD).
  • Prices may change without notice; however, confirmed bookings will honour the agreed price.
  • Lesson packages must be used within 6 months of purchase.

4. Cancellations and Rescheduling

  • A minimum of 24 hours’ notice is required to cancel or reschedule a lesson.
  • Lessons cancelled with less than 24 hours’ notice will be charged in full.
  • Failure to attend a scheduled lesson (no-show) will result in forfeiture of the lesson fee.
  • Exceptions may be considered in genuine emergencies at the instructor’s discretion.
  • We reserve the right to reschedule lessons due to instructor illness, mechanical issues, severe weather, or safety concerns.

5. Learner Requirements

Students must:

  • Hold and carry a valid NSW Learner or Provisional Licence during each lesson.
  • Be medically fit to drive.
  • Not attend lessons under the influence of alcohol, drugs, or medication that may impair driving ability.

If these requirements are not met, the lesson may be cancelled or terminated and charged in full.

6. Safety and Instructor Authority

Driving involves inherent risks. Students acknowledge and accept these risks when participating in lessons.

The instructor reserves the right to terminate a lesson immediately if:

  • The learner behaves in an unsafe, unlawful, or aggressive manner
  • The learner refuses to follow reasonable instructions
  • Road, weather, traffic, or vehicle conditions become unsafe

In such cases, no refund will be provided.

7. Vehicles and Dual Controls

Lessons are conducted in dual-control vehicles for safety. Students must take reasonable care when operating the vehicle. Deliberate or reckless damage caused by a learner may result in liability for repair costs.

8. Logbook Lessons (NSW)

  • Only lessons meeting government requirements will be signed off.
  • Eligible lessons count as 3 logbook hours in accordance with NSW regulations.
  • It is the learner’s responsibility to ensure logbook accuracy and compliance.

9. Driving Test Bookings

  • Use of the instructor’s vehicle for a driving test must be booked in advance.
  • Test packages are non-refundable once confirmed.
  • Additional time beyond the allocated package may incur extra charges.
  • We do not guarantee that a student will pass any driving assessment or test.

10. Lesson Packages and Promotions

  • Packages and special offers must be used within the stated validity period.
  • Packages are non-transferable.
  • Packages are non-refundable once commenced, except where required by Australian Consumer Law.

11. Limitation of Liability

To the maximum extent permitted by law, RevUp Driving School is not liable for:

  • Indirect, incidental, or consequential loss
  • Missed driving tests or associated fees
  • Delays caused by traffic, weather, or mechanical issues beyond our reasonable control
  • Loss of income or opportunity

Nothing in these Terms excludes your rights under the Australian Consumer Law that cannot be lawfully excluded.

12. Privacy

We collect and handle personal information in accordance with our Privacy Policy, available on our website.

13. Website Use

All website content is provided for general information purposes only. We make reasonable efforts to ensure accuracy but do not guarantee that content is error-free or up to date. All website materials are protected by intellectual property laws and may not be reproduced without permission.

14. Camera and Voice Recording Policy

14.1 Use of Cameras and Audio Recording

RevUp Driving School vehicles may be fitted with cameras and/or audio recording devices for:

  • Learner and instructor safety
  • Training and assessment review
  • Incident protection including disputes or accidents
  • Insurance and legal requirements
  • Quality assurance and service improvement

By booking lessons or entering a RevUp Driving School vehicle, you acknowledge and consent to recording during lessons.

14.3 Privacy and Use of Recordings

All recordings are handled in accordance with the Privacy Act 1988 (Cth) and are used only for legitimate business purposes. Recordings are not sold or shared except where required by law.

14.4 Access and Retention

Access is restricted to authorised personnel only. Recordings are retained only as long as necessary and then securely deleted.

14.5 Tampering

Learners must not interfere with recording equipment. Doing so may result in termination of lessons without refund.

15. Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of NSW courts.

16. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. The latest version published on our website will apply to all bookings.
